“Özel eğitime muhtaç engelli çocuklarımızın eğitiminin verildiği Özel Eğitim Kurumlarının işleyişini düzenleyen Milli Eğitim Bakanlığı Özel Eğitim Kurumları Yönetmeliği’nde, 05.09.2019 tarihinde değişiklik yapılmıştır.
Değişiklik ile normal eğitim yapılan okullarda öğrenim gören çocuklarımızın velinin isteği ile haftada yarım gün özel rehabilitasyon merkezlerine gitmeleri düzenlenmiştir. Bu düzenleme özel eğitime muhtaç çocuklarımızın okuldan alınarak özel eğitim ve rehabilitasyon merkezlerine gitmelerine zemin hazırlamaktadır.
Oysa ki bu çocuklarımızın eğitimi devletin asli görevleri arasındadır. Bu asli görevin özel kurumlara devredilmesi niteliğindeki düzenleme hukuka aykırıdır. Bu düzenleme, öğrencilerin okullarında almaları gereken programlarda da aksaklıklara neden olacaktır.
Bu çocukların eğitim ihtiyacı ve gelişimleri göz önüne alınarak Bakanlıkça hazırlanan programların uygulanamamasına sebebiyet verecek, kamu yararının ve bu çocukların eğitiminin göz ardı edildiği düzenlemeyi yargıya taşıdık.”
